(ŁOBEZ) W 1997 roku Sejm wprowadził do życia ustawę regulującą działalność gospodarczą osób zatrudnionych w sferze publicznej, mających kompetencje kierownicze. Ustawa ta nazwana została popularnie „antykorupcyjną”.
„Ustawa określa ograniczenia w prowadzeniu działalności gospodarczej przez: ...członków zarządów powiatów, skarbników powiatów, sekretarzy powiatów, kierowników jednostek organizacyjnych powiatu, osoby zarządzające i członków organów zarządzających powiatowymi osobami prawnymi oraz inne osoby wydające decyzje administracyjne w imieniu starosty”.
Od 2002 roku ustawa ta nie była przestrzegana w naszym powiecie. Na ten dość istotny fakt zwrócił uwagę jeden z forumowiczów łobeskiej Platformy Obywatelskiej. Dyrektor powiatowego liceum pani Jolanta Manowiec od 2002 roku, poza pracą na swoim stanowisku, prowadziła również działalność gospodarczą, posiadając udziały w spółce cywilnej, produkującej biopaliwa. Internauta zwrócił się z zapytaniem do wicestarosty Wiesława Bernackiego, żądając wyjaśnienia tej sprawy. Starosta stwierdził, że w maju 2005 roku interweniował w tej sprawie i wspomniana osoba zrezygnowała z udziału w spółce. Jeszcze kilka lat wcześniej nikt ze sprawdzających wówczas oświadczenia majątkowe nie zwrócił na to uwagi.
- Być może było to przeoczenie, być może była to wina niedokładnego przeczytania. Na tamten czas na pewno było to złamanie ustawy. Było to jednak przeoczenie dwóch stron i nie uznaliśmy tego za działanie świadome. Błąd został naprawiony. – stwierdził wicestarosta Bernacki.
Drugą kwestią do rozwiązania pozostaje dość dwuznaczna pozycja dyrektora tego liceum, który jest jednocześnie dyrektorem prywatnej szkoły “Progres”, która mieści się w tym samym budynku. Konflikt interesów wydaje się być widoczny chociażby w przypadku, gdy dyrektor szkoły publicznej negocjuje cenę za wynajem pomieszczeń dla szkoły prywatnej z... własnym pracodawcą, jakim staje się właściciel zatrudniający dyrektora szkoły publicznej na posadzie dyrektora szkoły prywatnej.
